A tenant Russell Calum McLean, (the Pursuer) alleges that his landlord, Angus Housing Association Ltd (the Defender):-

(i). Knows, or should know that he is disabled following injury during his service as a police officer.

(ii) As of today’s date 7th February 2025, Angus Housing Association Ltd., will know, that their tenant is disabled; both physically and TBI.

(iii) The Defender will know this because the documents and related counterpart material to which this page relates has been hand delivered in paper format (today 7-2-2025) with photographic corroborated material herewith.

(iii) Consequently, Angus Housing Association Ltd., and in law, their “directing mind” (described as a “Chief Executive Officer”) will, in the event of further strokes (allegedly caused) by the landlord’s ultra vires conduct, be competent under culpable manslaughter law and in particular the legal concept of “gross indifference to consequence” (in the event of the legislation that fell in 2021 being reintroduced as a result of measure being progressed that are currently outwith the scope of this immediate matter).

(iv). Should the Defender persist in their chronic ultra vires conduct of a litany of letters and phone calls relating to imagined slights and job-bloating bin-warden employees with no training in how to respect and approach people with disabilities then appropriate remedial protection will require to be sought from the duty Sheriff at Forfar Sheriff Court.

(v). A significant proportion of letters authored by Angus Housing Association Ltd., include legally wrong and gratuitously distressing “implied loss of tenancy.” This litany of amateur threats to all tenants and lazy approach when just one tenant might have made a minor infraction brings the Defender’s charity and the Charity Commission (OSCR) into disrepute.

(vi). This 10 year litany of ultra vires must stop, before the de facto hospitalisation of a disabled child and the de facto causing an OAP to have a second stroke deteriorates to a lethal third/subsequent stroke or the death of a child in an unsafe building.

(vii). The documents on this page may form part of one or more cases relating to the Defender and several current/former tenants.

(viii) In fairness to the Defender, they are entitled to see relevant documents that may be led in evidence at civil court.

(ix). It is legally prohibited to interfere of compromise a police investigation, so material relating to that cannot be included herewith.

(x). With respect, and for the sake of fairness, the Pursuer recommends the Defender to seek legal advice as their amateur and ultra vires conduct has already hospitalised a young girl and caused a stroke survivor ad second stroke.

This is very difficult as the landlord, Angus Housing originally built a bin-store for 1 wheelie-bin per household.

Instead, the implied threat to evict tenants is never far from the officious bin-warden and his clumsy attempts to intimidate tenants by quoting housing rules and regulations. He alleges, in his letter to all tenants, that his rules have been broken. He signs his authored scattergun letters (to innocent as well as allegedly guilty tenants). He is wrong on many counts.

Now, in January 2025, there has been a steady increase spanning several years from 1 wheelie bin per household capacity to FOUR wheelie-bins per dwelling PLUS a brown food waste bucket per household, Angus Housing Association failed to identify this problem and place blame on the tenants at Thistle Street, Carnoustie, DD7 7PR.

This demonstrates one of many (albeit low-level) but chronic failings of Angus Housing Association in its formal submission to the Office of the Scottish Charity Regulator (OSCR). Suspension of the charity registration either voluntarily or on an ex parte basis to the duty sheriff at Forfar Sheriff Court a motion to prevent the very real risk, based on evidence to date, that Angus Housing Association Ltd., have within its employ, ill or inadequately trained persons who will end up causing a death. That these risks require the gravitas of a Court Order to prevent people who are ignorant of the law, from causing death to those whom they are legally required to safeguard.

To date, there have been ingathered 11 alleged infractions with 16 corroborative witnesses (21 if hostile witnesses are included).

Alleged infractions ranging from wheelie-bin-gate s the bin-warden is referenced locally, to the very real hospitalisation of a tenant’s child due to poorly maintained housing stock, right up to the an irate employee of Angus Housing Ltd., causing a known stroke survivor to have his blood pressure elevated to 214/111; that being a “hypertensive crisis” according to Medico-Legal testimony.

This is provided in terms of (alleged) gross negligence on the actions of an ignorant or malevolent staff member to cause the tenant to endure and be diagnosed as having suffered a second stroke. That second stroke at the hands of Angus Housing Association Ltd.

There is, in excess of 10-year experience of tenants’ in this Angus Housing Associations failure to honour its undertaking to the Office of the Scottish Charity Regulator (OSCR).

The only entity with the authority to remedy the “bin problem” is Angus Housing Association Ltd. They require to either CEASE & DESIST harassing tenants on a problem the tenants cannot solve, or Angus Housing Association’ Ltd., management at a pay and responsibility level of £80,000 to £100,000 per annum require to justify such a level of salary by recognising where they “own” a problem and the damage their “charity” does to the reputation of the Office of The Scottish Charity Regulator (OSCR) by risking the lives of vulnerable and/or disabled tenants.

Paying scarce financial resources out to a “bin warden” when the problem does NOT reside with the tenants requires to be remedied and not by a “golden goodbye.”

So, whilst tenants are trying to run/establish charities (at no personal charge nor personal gain) to ensure pensioners avoid freezing to death, they have to contend with being stalked by a bin warden who has no evident credentials to know of, let alone abide by the requirement that underpins the financially very valuable CHARITY REGISTRATION as claimed by Angus Housing Association Ltd..

That organisation appear to enjoy the advantages of being a charity without having to bother about actually adhering to what they have legally stated they will do.
